This document constitutes the terms and conditions (“Conditions”) applicable to all participants (“Players”) taking part in Apollo Tyres Limited (“ATL”) Road to Old Trafford, 5-A Side Football Tournament 2025 being held across multiple cities in India (“Tournament”). By registering for and entering the Tournament, Players agree to be bound by these terms and conditions including the changes to the Tournament and confirm that all the information submitted is true, accurate and complete. ATL reserves the right to: (i) verify the eligibility of any and all Players; and (ii) disqualify any entries which ATL deems in its absolute discretion as defamatory, negative or offensive or which do not comply with internal guidelines. ATL may, in its sole discretion, disqualify any Player that fails to satisfy the eligibility requirements. Players shall at all times act in good faith towards ATL and the Tournament.
1. INFORMATION ABOUT US
ATL is the official sponsor of the Tournament, and its corporate office is situated at Apollo House, 7 Institutional Area, Sector 32, Gurugram, Haryana – 122 001, India.
2. ELIGIBILITY
You hereby warrant that You are eligible to participate in the Tournament and :- a. You understand the contents of the document in English and are capable of understanding and following instructions by the organisers and their partners/agencies. .
b. You are legally capable of entering into binding contracts; and
c. You are at least 18 years old.
d. You are medically fit and possess the standard competence necessary for the Tournament of this nature.
3. ELIGIBILITY
a. A team must consist of a minimum of five (5) and maximum of seven (7) players (“Team”).
b. Employees of ATL or any of its associated companies or subsidiaries (and their families) are excluded from entering the Tournament.
4. REGISTRATION PROCESS
a. The Team must fill and complete the online registration form available on ATL’s official website for its registration in the Tournament. After successful submission of the registration form, the organizing team on behalf of ATL shall contact the Team for further details. The registered Team will also be communicated the necessary steps for the payment of a registration fee for the Tournament (“Registration Fee”).
b. Teams are required to promptly respond to communications and provide any required information requested by the organizing team of ATL and also deposit the payment of the Registration Fee within the time period communicated by ATL. Failure by the Team to provide the requested information and /or nonpayment of the Registration Fee may result in the forfeiture of the Team’s participation in the Tournament.
c. Please note that the participation and registration for the Tournament is on a first-come first-serve basis and with a limited number of slots available. No payment of the Registration Fee shall be received without registration for the Tournament by the Team on the website of ATL. Notice of a confirmed enrollment will be sent to you by an email acknowledgement wherever possible, as soon as, details of your payment have been processed and entered onto our system. ATL reserves the right to cancel the registration of any Team found in violation of the eligibility rules or any Conditions mentioned herein.
5. PAYMENT
A non-refundable Registration Fee of INR 5,000/- (Five Thousand Rupees ) inclusive of taxes shall be paid by the Team for its participation in the Tournament after submission of the registration form available on the website of ATL. The organizing team of ATL shall reach out to the registered Team after the successful submission of the registration form as stated above, who will provide the necessary details as to the mode and manner in which the Registration Fee is to be paid for the successful registration for the Tournament.
6. PRIZE
a. The winner Team of the Tournament shall get a chance to play at the Old Trafford Stadium, home of football giant Manchester United.
b. The Prizes are non-transferable and there is no cash alternative.
7. PLAYER AND TOURNAMENT PROTECTION
ATL treats as a priority, the safety and well-being of all the Players attending the Tournament. ATL reserves the right to remove from the Tournament, any Player who is found to be engaging in offensive activity including bullying of others, disruptive behavior or for any other reason where ATL considers a Player’s behavior is detrimental to the interests or safety of others including disturbing the peace and tranquility of the Tournament and disparaging the brand and goodwill of ATL. In the event of removal from the Tournament for any disciplinary reasons, no refund of any fees paid shall be made.
8. CANCELLATION POLICY
a. In the event of any withdrawal or cancellation by the Team after successful registration and payment of the Registration Fee, no refund of the Registration Fee shall be made by ATL.
b. In case of any requirement of local travel arrangements, the same shall be arranged by ATL provided You shall not hold ATL liable or accountable in any way for any expenses incurred by You for participation and preparation for the Tournament or for any other travel arrangements organised by You. ATL reserves the right to cancel or reschedule the Tournament. In the event that the Tournament is cancelled/not held for any reason whatsoever including but not limited to Force Majeure Event (defined below), the Registration Fee paid by the Team will be refunded within sixty (60) days from date of cancellation.
9. THIRD PARTY SERVICE PROVIDERS
a. You understand that although ATL is sponsoring the Tournament its responsibility is limited to seeking services from various agencies (the “Third-Party Service Providers”). Hence You understand and acknowledge that these Third-Party Service Providers are independent Parties and are not the employees of ATL and are providing defined services in an independent capacity.
b. You understand that ATL does not and shall not be deemed to manage, control or supervise the goods or services supplied by the Third-Party Service Providers and shall not be liable for any acts or omissions, including any negligence, gross negligence, or reckless or willful acts, on the part of ThirdParty Service Providers or any other defect in such goods or services.
c. You shall not hold ATL liable or accountable in any way for any injury, loss, damage, delay, or death or property loss or damage arising from any act or omission of any of the Third-Party Service Providers.
10. LIABILITY
a. You declare that you are intending to participate in this Tournament and acknowledge and understand the risk of physical injury and assume all the foregoing risks and accept personal responsibility for any and all damages, loss, delay in connection with any injury, accident, mishap, property loss , temporary or permanent disability or death that may occur being part of the Tournament, irrespective it is arising out of any act or omission of any of the Third-Party Service Providers. You shall not hold ATL liable or accountable for the same;
b. You further declare that You (a) agree that prior to participating, it is the responsibility of the Player to bring upon immediate notice to the official if facilities and equipment provided are unsafe and can delay the participation until such condition(s) is corrected; and (b) acknowledge and fully understand that the Player will be engaging in activities that involve risk of physical injury, including, without limitation, temporary or permanent disability and death, and severe social and economic losses which might result not only from the Player’s own actions, inactions or negligence, but from the actions, inactions or negligence of ATL, its member teams, Third Party Service providers, any other Program sponsors, and each of their respective related entities and affiliates, administrators, agents, officers, owners and employees, other Players, referees, scorers, timers, trainers, security personnel and sponsoring agencies (collectively, the “Releasees”), the rules of play of the Program, the condition of the premises or of any equipment used and that there may be other risks not known to Player or the Releasees or not reasonably foreseeable at this time;
c. You further release, waive and forever discharge the Releasees from all liability including vicarious liability and any and all claims of damages including claim for death, personal injury or property damage which the undersigned, the Player, or any of the personal representatives, heirs, assigns or next of kin of Player (collectively, the “Releasors”) may have or which may hereafter accrue to any of the Releasors, as a result of the Player’s participation or otherwise, and which may be asserted by any of the Releasors against the Releasees;
d. You agree to defend indemnify and save and hold harmless the Releasees and each of them from any loss, liability, claim, damage, judgment, legal fees or costs , actions, expenses, demands, fines, penalties, charges, court orders, judgements, litigations (including reasonable attorney’s cost) in relation to (i) injury and/or loss of life to myself or any other person participating along with me in the Event, (ii) loss and/or damage to any property; arising from or incurred due to the Player’s participation in or otherwise in connection with the Tournament or as a result of any cause whatsoever relating to Player’s participation in the Tournament, whether caused by the negligence of any of the Releasees or otherwise;
e. You hereby waive your right to initiate any legal action against ATL, with respect to the Tournament.
11. RESPONSBILITY OF THE PLAYER
a. You have appropriate accident and/or medical insurance coverage to cover any health or injury related hospitalization expenses, and You shall not hold the ATL liable for such medical and/or hospitalization expenses.
b. You shall be personally liable, at all times, to guard your personal belongings against theft, loss or damage and ATL shall not be in a position to guard or protect the same.
12. NOTICES
All notices must be communicated to ATL. Notices will be deemed received and served seventy-two (72) hours after an e-mail is sent.
13. PRIVACY & INTELLECTUAL PROPERTY
Any personal data relating to the Team or any other entrants will be used solely in accordance with applicable data protection legislation and rules. ATL may share the personal data with any third party only as necessary and required for the purpose of the prize and the Tournament. You voluntarily grant permission and give consent to ATL to use your photo, images, video from the Tournament for their various training, internal, external and commercial purposes of the Company. Hence, ATL reserves the right to use your photographs and videos etc., the Team and/or the Players on public platforms including social media and may use or reproduce the same for marketing and promotional purposes. ATL shall have the right to the use same for advertising, promoting and publicizing the Tournament in accordance with the Conditions.
14. EVENTS OUTSIDE OUR CONTROL
You shall not hold ATL liable or responsible for any failure to perform, or delay in performance of any obligations, that is caused by events outside our reasonable control (“Force Majeure Event”). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
a. Strikes, lock-outs or other industrial action.
b. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
c. Fire, explosion, storm, flood, earthquake, subsidence, rain/unavailability of the ground or facilities, pandemic, epidemic or other natural disaster.
d. Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
e. Impossibility of the use of public or private telecommunications networks.
f. The acts, decrees, legislation, regulations or restrictions of any government.
g. Accident, mechanical breakdowns, weather, any other act of God, political closures, statutory orders, or any untoward incidents.
Performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues. We will make reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which the obligations may be performed despite the Force Majeure Event. No waiver by ATL of any of these Conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you by writing.
12. AMENDMENTS
These Conditions may be altered / changed for legal or administrative reasons by ATL only.
13. SEVERABILITY
If any of these Conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law
14. ENTIRE AGREEMENT
These Conditions and any other document provided by ATL represent the entire agreement between ATL and you in relation to the relevant subject matter and supersedes any prior agreement, understanding or arrangement, whether oral or in writing. These Conditions can be altered or changed at any stage by ATL. This declaration cum undertaking cum indemnity bond shall be binding on my heirs, executors, and legal representatives.
15. LAW AND JURISDICTION
Any dispute or claim arising out of or in connection with these Conditions, noncontractual disputes or claims will be governed by Indian law and shall be subject to the jurisdiction of the courts of Delhi, India.
